David Cole: It’s not the Roberts Court, it’s the Kennedy Court

David ColeCole-rainbowflag-ap_img writes in the current issue of The Nation, a special issue on the 10th anniversary of the Roberts Court, that not every Supreme Court decision in the ten years since John Roberts became Chief Justice has been terrible.  A balanced view has to take into account liberal decisions on gay marriage, habeus corpus, Fourth Amendment privacy rights, criminal justice, and free speech, among other issues.  But, he writes, “the Court is so closely divided, a single appointment could have dramatic consequences.”
